Plain Language Summary
We've tried to make these terms as clear as possible. In short: use Bovella responsibly, respect others, and we'll work hard to deliver your messages reliably. If you have questions, just ask.
1. Acceptance of Terms
By creating an account or using Bovella ("Service"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the service.
You must be at least 18 years old to use Bovella. If you're using it on behalf of an organization, you confirm you have authority to bind that organization to these terms.
2. Description of Service
Bovella is a platform that allows you to:
- Record and upload video messages
- Schedule these messages for future delivery to designated recipients
- Store videos securely until their scheduled delivery date
- Manage your message library and delivery settings
Beta Status
Bovella is currently in beta. This means the service is provided "as is" while we continue to develop and improve it. Features may change, and we appreciate your patience and feedback.
3. Your Account
You are responsible for:
- Keeping your login credentials secure
- All activity that occurs under your account
- Promptly notifying us of any unauthorized access
- Providing accurate and up-to-date information
We may suspend or terminate accounts that violate these terms or appear to be compromised.
4. Acceptable Use
Prohibited Content
You may not upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. We reserve the right to remove such content and terminate accounts that violate these rules.
You agree to use Bovella only for lawful purposes. Specifically, you will not:
- Upload content that you don't have rights to share
- Harass, threaten, or harm others through your messages
- Attempt to access other users' accounts or data
- Use the service for commercial spam or advertising
- Interfere with or disrupt the service's infrastructure
- Create multiple accounts to circumvent restrictions
5. Content Ownership
Your Content
You retain full ownership of the videos and content you upload. By using our service, you grant us a limited license to:
- Store and process your content
- Deliver your content to designated recipients
- Create backups for redundancy
- Display your content to you in the app
This license terminates when you delete your content or account.
Our Content
All Bovella branding, software, designs, and documentation remain our property. You may not copy, modify, or redistribute our intellectual property without permission.
6. Message Delivery
We commit to making every reasonable effort to deliver your messages on schedule. However, we cannot guarantee delivery in all circumstances, including:
- Invalid or outdated recipient email addresses
- Technical failures beyond our control
- Messages blocked by recipient's email provider
- Legal requirements to withhold delivery
We recommend you:
- Keep recipient email addresses up to date
- Test delivery with yourself first
- Add backup recipients for critical messages
7. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using Bovella, you agree to our privacy practices.
8. Payment Terms
During our beta period, all features are free. When we introduce paid plans:
- We'll notify you in advance with clear pricing
- Existing users will receive special consideration
- Free tiers may remain available with limited features
9. Service Changes
We may modify, suspend, or discontinue parts of the service at any time. For significant changes that affect your stored content, we will:
- Provide reasonable advance notice
- Give you opportunity to download your content
- Honor scheduled deliveries where possible
10. Termination
By You
You may delete your account at any time through your account settings. We will delete your content within 30 days of account deletion. Scheduled messages that haven't been delivered will be cancelled.
By Us
We may terminate or suspend your account if you:
- Violate these Terms
- Engage in illegal activity
- Abuse the service or other users
- Create risk or legal exposure for us
11. Disclaimers
Bovella is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure against all threats.
While we implement strong security measures, no system is perfect. You acknowledge that you upload content at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, Bovella shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 during the free beta period).
13. Indemnification
You agree to indemnify and hold Bovella harmless from any claims arising from your use of the service, your content, or your violation of these Terms.
14. Dispute Resolution
We prefer to resolve disputes informally. If you have a concern, please contact us at legal@bovella.com first. Most issues can be resolved through good-faith discussion.
If we cannot resolve a dispute informally, you agree to resolve claims through binding arbitration rather than court litigation, except for claims that may be brought in small claims court.
15. General Terms
- Entire Agreement: These Terms constitute the entire agreement between you and Bovella
- Severability: If any provision is found unenforceable, the rest remains in effect
- No Waiver: Failure to enforce any right doesn't waive that right
- Assignment: You may not assign your account; we may assign these Terms
16. Changes to Terms
We may update these Terms from time to time. We'll notify you of material changes via email or through the service. Continued use after changes indicates acceptance.
